If you do not agree with any part of these Terms, you must not use the Site or its services.
1. About The Talent Catalog
The Talent Catalog is an online platform and resource network for arts and entertainment creatives. We provide tools for members to build Electronic Press Kit (EPK) pages, create business and service listings, connect with other creatives, and access educational content. We act as a platform provider — we do not employ, represent, or manage the talent or businesses listed on the Site.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account or use our services. By registering, you confirm that the information you provide is accurate, current, and complete, and you agree to keep it updated.
3. Account Registration & Security
When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately if you suspect any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent or harmful purposes.
4. Membership Plans & Payments
The Talent Catalog offers paid membership plans (EPK, Business, and Star tiers) with different features and pricing. By subscribing to a paid plan, you agree to the following:
• Subscriptions are billed on a recurring monthly basis through our payment processor, Stripe.
• You authorize us to charge your payment method on file for the applicable subscription fee.
• You may cancel your subscription at any time through your account dashboard or the Stripe billing portal. Cancellation takes effect at the end of the current billing period — no partial refunds are provided for unused time within a billing cycle.
• We reserve the right to change pricing with reasonable notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
• Free trials or promotional coupons, when offered, are subject to their own terms and limitations.
5. User Content & Responsibilities
"User Content" refers to any text, images, videos, audio, links, or other material you upload, publish, or share through the Site — including but not limited to EPK pages, business listings, profile information, messages, and course submissions.
You retain ownership of your User Content. However, by posting it on the Site, you grant The Talent Catalog a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content in connection with the operation of the platform.
You are solely responsible for the content you publish. You agree that your content:
• Is accurate and does not misrepresent your identity, qualifications, or services.
• Does not infringe on any third party's intellectual property, privacy, or other rights.
• Does not contain illegal, defamatory, harassing, threatening, or obscene material.
• Does not include malware, spam, or deceptive links.
• Complies with all applicable local, national, and international laws.
We reserve the right to remove or modify any content that violates these Terms, without prior notice.
6. EPK Pages & Subdomains
Members with eligible plans may create an EPK page hosted on a subdomain of boostaco.com (e.g., yourname.boostaco.com). Subdomains are assigned on a first-come, first-served basis and are subject to the following:
• Subdomain names must not impersonate other individuals, brands, or organizations.
• Subdomain names must not contain offensive, misleading, or trademarked terms.
• We reserve the right to reclaim or reassign subdomains at our discretion, particularly in cases of inactivity, violation of these Terms, or legitimate trademark claims.
• Your EPK page and subdomain remain active as long as your membership is in good standing. If your subscription lapses or is cancelled, your EPK page may be unpublished or removed after a reasonable grace period.
7. Business Listings
Business and service listings submitted through the platform are subject to review and approval by our team. We reserve the right to reject, modify, or remove any listing that does not meet our quality standards or violates these Terms. Approval of a listing does not constitute endorsement of the business or its services.
8. Prohibited Conduct
When using the Site, you agree NOT to:
• Use the platform for any illegal or unauthorized purpose.
• Harass, abuse, threaten, or intimidate other users.
• Scrape, crawl, or use automated tools to extract data from the Site without permission.
• Attempt to gain unauthorized access to other accounts, systems, or networks.
• Interfere with or disrupt the operation of the Site or its servers.
• Use the Site to distribute unsolicited commercial messages (spam).
• Create multiple accounts to circumvent restrictions or abuse promotional offers.
• Resell, sublicense, or commercially exploit access to the platform without written consent.
9. Intellectual Property
The Talent Catalog name, logo, website design, original content, and underlying technology are the property of The Talent Catalog and are protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute any part of the Site without our express written permission.
This does not affect your ownership of your own User Content as described in Section 5.
10. Third-Party Services & Links
The Site may contain links to third-party websites, services, or content (including social media profiles, payment processors, and embedded media). These are provided for convenience only. We do not control, endorse, or assume responsibility for third-party content, products, or services. Your interactions with third parties are governed by their own terms and policies.
11. Disclaimer of Warranties
The Site and its services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not guarantee that:
• The Site will be uninterrupted, error-free, or completely secure.
• Any information on the Site (including user-submitted content) is accurate, reliable, or complete.
• The platform will meet your specific requirements or expectations.
We are a platform that connects creatives and service providers. We do not guarantee the quality, safety, or legality of any user's services, and we are not a party to any agreements made between users.
12. Limitation of Liability
To the maximum extent permitted by law, The Talent Catalog and its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site, including but not limited to loss of data, loss of revenue, or business interruption — even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless The Talent Catalog, its owners, operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Site, your User Content, your violation of these Terms, or your infringement of any third party's rights.
14. Termination
We may suspend or terminate your account and access to the Site at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, prolonged inactivity, fraudulent activity, or requests from law enforcement.
Upon termination, your right to use the Site ceases immediately. We may, at our discretion, delete your account data and User Content. Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.
15. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Site, you consent to the practices described in the Privacy Policy.
16. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page.
